What is mediation?

Mediation is a form of alternative dispute resolution, giving parties an opportunity to resolve their dispute without going to trial.  It is a voluntary process, meaning all parties must agree to participate and any party may terminate the mediation at any time.

If the parties agree, they will meet with a mediator: a neutral individual who does not decide the case for the parties nor act as an advocate for either party. Because of this, the mediator will not give any legal advice, but instead facilitates the parties in achieving a mutually acceptable resolution.

Why mediation over litigation?

Mediation is usually less costly and more expeditious than going to court.

Parties may explore many different options during mediation but remain free to return to the traditional court process at any point.

Anything said during the mediation is completely confidential, meaning nothing can be repeated in court and the mediator cannot be called to testify as a witness at trial.
